Trespassing Report Leads to Drug Charges

A Wewoka man is facing multiple charges after being stopped as a potential trespassing suspect.

According to court documents, Zachary Heath Weger, 31, has been charged with one felony count of driving under the influence, one misdemeanor count of possession of a controlled dangerous substance, and one misdemeanor count of trespassing after being forbidden.

According to an affidavit filed in the case, Seminole County Sheriff’s Deputy was dispatched to a location near Wewoka Lake to investigate a report of a burglary in progress. The reporting party stated his mother had called him reporting someone was in her yard trying to break into her residence and he was in route to the scene at that time.

Before Deputy Word arrived the party called back and said the truck was trying to leave and he was following the suspect. Seminole Lighthorseman Drake Richardson was near the area and stopped the vehicle on Highway 59 and detained Weger in his patrol vehicle until Deputy Wood could arrive.

When Deputy Word and Deputy Michael Windle arrived and spoke with the son, it was determined that his mother’s property wasn’t marked no trespassing, and the suspect was not confirmed out of his vehicle at the address. Weger stated that he thought he was at a friend’s property and didn’t realize he was trespassing on someone else’s property.

Deputy Word observed that the suspect’s eyes were very red and bloodshot, his eyelids were very heavy, and he was having trouble keeping them open while speaking to law enforcement, the affidavit states. His head kept falling towards his chest and popping back up as if he were falling asleep, and he was disoriented and somewhat confused. Deputy Windle asked him if he had been drinking and he stated no, he did not appear to be drunk, and he did not smell of alcohol. Deputy Windle asked Weger when he last used drugs, and he stated he had smoked marijuana approximately 1 – 2 hours prior, and when Deputy Word asked if (See Felony on Page 10) (Continued from Page 1) he had used any drugs, he replied that he had taken some hydrocodone that was not prescribed to him, according to the affidavit.

After Deputy Windle was given permission to search the vehicle, a small, black snap type container was found in the driver’s door panel with two bags of a white and brown substance later identified as methamphetamine weighing 3.37 grams, four plastic baggies, and a portion of an unidentified pill, the affidavit states.

Weger was placed in custody, and Lighthorseman transported him to Seminole County Jail, since he was already in that patrol unit. Bond was set at $3,000 with OCS supervision, according to court minutes.
