Seminole City Council to Meet This Evening

The Seminole City Council and its related authorities will meet Tuesday, April 11 beginning at 7 p.m. at the Reynolds Wellness Center. Agenda items are listed below. The meeting is open to the public.

Municipal Authority Agenda Consideration and possible action to approve the wastewater treatment plant (WWTP) “bridge” loan payment of $74,607.90 for Invoice No. 5 to Wall Engineering, to be funded from a line of credit for Construction in Progress-Wastewater Treatment Plant.

City Council Agenda Mayoral proclamation of April 2023 as Autism Acceptance Month.

Consideration and possible action to approve the low bid of $17,932 from Metro Emergency Upfitters, LLC, for emergency equipment and lights on two (2) new patrol vehicles, to be funded from capital improvement (CIP) budget funds.

Consideration and possible action to approve the low bid of $8,450 from Tri County Heat & Air, LLC, for replacement of a rooftop HVAC unit at the Police Department, to be funded from insurance proceeds of the May 2022 tornado.

Consideration and possible action to approve the low bid of $37,600 from Great Western Leasing and Sales for a used 48’ tandem trailer for the Streets department, to be funded from capital improvement (CIP) budget funds.

Consideration and possible action to approve bids of $576,100, plus $15,000 in additional repairs, from Heritage Hills for repairs/ replacement of roofs on three (3) city buildings that were damaged during the May 2022 tornado, to be funded from insurance proceeds. The three buildings are Farmer’s Market, Heritage House and Emergency Services/Public Works on Harvey Road.

Consider approving Participation in the Walgreens Settlement Agreement dated December 9, 2022, the Retailer State-Subdivision Agreement as it pertains to the Walgreens Settlement Agreement, and the State Back-Stop Agreement applicable to the Walgreens Settlement Agreement, as recommended by Todd Court and Tony G. Puckett, McAfee Taft, legal counsel for the City of Seminole and other litigating Oklahoma subdivisions, including approval of Resolution No. 2023-07, and authorize the Mayor of the City of Seminole to execute the Subdivision Participation Form for the City of Seminole’s participation in the Walgreens Settlement Agreement.

Consider approving Participation in the Walmart Settlement Agreement November 22, 2022, the Retailer State-Subdivision Agreement as it pertains to the Walmart Settlement Agreement, and the State Back-Stop Agreement applicable to the Walmart Settlement Agreement, as recommended by Todd Court and Tony G. Puckett, McAfee Taft, legal counsel for the City of Seminole and other litigating Oklahoma subdivisions, including approval of Resolution No. 2023-08, and authorize the Mayor of the City of Seminole to execute the Subdivision Participation Form for the City of Seminole’s participation in the Walmart Settlement Agreement.

Consider approving Participation in the CVS Settlement Agreement dated December 9, 2022, and the Retailer State-Subdivision Agreement as it pertains to the CVS Settlement Agreement, and the State Back-Stop Agreement applicable to the CVS Settlement Agreement, as recommended by Todd Court and Tony G. Puckett, McAfee Taft, legal counsel for the City of Seminole and other litigating Oklahoma subdivisions, including approval of Resolution No. 2023-09, and authorize the Mayor of the City of Seminole to execute the Subdivision Participation Form for the City of Seminole’s participation in the CVS Settlement Agreement.

Consider approve Participation in the Allergan Settlement Agreement dated November 22, 2022, and the Allergan State-Subdivision Agreement and the Allergan State Back-Stop Agreement, as recommended by Todd Court and Tony G. Puckett, McAfee Taft, legal counsel for the City of Seminole and other litigating Oklahoma subdivisions, including approval of Resolution No. 2023-10, and authorize the Mayor of the City of Seminole to execute the Subdivision Participation Form for the City of Seminole’s participation in the Allergan Settlement Agreement.

9. Consider approving Participation in the Teva Settlement Agreement dated November 22, 2022, and the Teva State-Subdivision Agreement and the Teva State Back-Stop Agreement, as recommended by Todd Court and Tony G. Puckett, McAfee Taft, legal counsel for the City of Seminole and other litigating Oklahoma subdivisions, including approval of Resolution No. 2023-11, and authorize the Mayor of the City of Seminole to execute the Subdivision Participation Form for the City of Seminole’s participation in the Teva Settlement Agreement.

Consideration and possible action to approve Ordinance No. 1287, an Ordinance amending the use and placement of “shipping containers” within the city of Seminole.

Consideration and possible action to approve waiving fees for garage sales for the City- Wide Garage Sale Weekend scheduled for Thursday, June 1 through Saturday, June 3.

Consideration and possible action to approve the engagement letter with Dillon & Associates, PC, for the annual audit as of June 30, 2023, in the amount of $33,600 for the City of Seminole; $4,500 for the single audit supplement for federal and state grants; and $6,300 for the Seminole Economic Development Council (SEDC).

Consideration, discussion and possible action to enter into executive session under Oklahoma Statute 25 O.S. § 307(B)(3), discussing the purchase or appraisal of real property.

Consideration, discussion and possible action to enter into executive session to hold confidential communications between the City Council of the City of Seminole and its counsel concerning the settling of certain claims in pending litigation (City of Seminole v. Purdue Pharma, L.P.., et al., 19-op-45260DAP, pending in the United States District Court for the Northern District of Ohio, City of Ada, et al. v. Walmart Inc., f/k/a Wal-Mart Stores, Inc., et al., Case No. CJ-22-250 filed in the District Court of Pottawatomie County, Oklahoma, and Board of County Commissioners of Harmon Count, et al., v. CVS Health Corp., Case No. CJ-2023-00105, filed in the District Court of Pottawatomie County, Oklahoma), including potential resolution of certain claims against Walmart, Walgreens, CVS, Teva, and Allergan, related to lawsuits against pharmaceutical supply chain participants of opioid prescription drugs, and taking appropriate action in open session, including possible authorization to settle claims, the disclosure of which may seriously impair the litigation if known by public disclosure as allowed by 25 O.S. § 307(B)(4).
