ORDINANCE 1236

AN ORDINANCE AMENDING TITLE 15, TRAFFIC & VEHICLES, CHAPTER 5, DRIVING, OVERTAKING, PASSING; SECTION 31, TRUCK DRIVING AND ROUTE RESTRICTIONS. BE IT ORDAINED BY THE PEOPLE OF THE CITY OF SEMINOLE, OKLAHOMA THAT THE FOLLOWING SECTION BE ADDED TO THE SEMINOLE CODE OF ORDINANCES:

15-5-31: TRUCK ROUTES:

A. ROUTES DEFINED: The City Council, by motion or resolution, may prescribe routes through the city for the use of trucks in general, trucks of particular kinds and/or/ other vehicles which are not ordinary private passenger vehicles, passing through the city.

1. No person shall drive a truck on any street, road or highway that is not designated as part of a truck route.

2. Appropriate and adequate signs shall be places along such routes so that drivers of such vehicles may follow the routes. When such signs are so erected and in place, the driver of a truck or other vehicle for which a route has been prescribed, as provided above, while passing through the city, shall keep on such route and shall not deviate therefrom except in case of emergency.

3. Exceptions to prohibition:

a. When the destination of the truck requires travelling on streets not part of the truck route for a delivery to or from a customer or to provide a service at a residence or business. In such an event the route must be limited to the minimum necessary to accomplish the delivery or service call;

b. Buses

c. Public mass transit vehicles

d. Fire trucks, military or other emergency vehicles

e. Road construction and maintenance equipment, while vehicle is being used for this purpose

f. Farm tractors, implements, combines, flatbeds, farm trucks no greater than thirty feed (30') in length.

g. Sport utility vehicles or light or full size pickups.

4. A violation of these provisions shall be a misdemeanor and punishable in accordance with Section 1-1-8 of the Code of Ordinances.

5. 5. In the event that damage occurs to real or personal property as a result of a violation of this provision, the Court may assess the damage as restitution against the responsible party in favor of the City of Seminole, its Trust authorities or other appropriate party.

B. MAP OF ROUTES REQUIRED:

The city clerk shall keep and maintain accurate maps setting out the truck routes as designated by the city council.

PROCLAMATION AND NOTICE OF ELECTION

Under and by virtue of Section 26, Article X of the Oklahoma Constitution and Title 70, Article XV, Oklahoma Statutes 2011, and other laws supplementary and amendatory thereto and a Resolution of the Board of Education of Independent School District Number 3 of Seminole County, Oklahoma, adopted on the 9th day of December, 2019, an election is hereby called to be held in said School District on the 11th day of February, 2020, for the purpose of submitting to the registered, qualified electors thereof the following proposition:

PROPOSITION

Shall Independent School District Number 3 of Seminole County, Oklahoma, incur an indebtedness by issuing its bonds in the sum of Four Hundred Thousand Dollars ($400,000) to be issued in one or more series to provide funds for the purpose of constructing, equipping, repairing and remodeling school buildings, acquiring school furniture, fixtures and equipment and acquiring and improving school sites, and levy and collect an annual tax, in addition to all other taxes, upon all the taxable property in such District sufficient to pay the interest on such bonds as it falls due and also to constitute a sinking fund for the payment of the principal thereof when due, said bonds to bear interest not to exceed the rate of ten (10%) percentum per annum, payable semi-annually and to become due serially within ten (10) years from their date?

The ballots used at said election shall set out the proposition as above set forth and shall also contain the following words:

Against the above Proposition

The polls shall be opened at seven o’clock A.M. and remain open continuously until and be closed at seven o’clock P.M.

The number and location of the polling places and the names of the persons who shall conduct said election shall be designated by the County Election Board(s). Such officers shall also act as counters.

The specific projects for which at least eighty-five percent (85%) of the proceeds of the aforesaid Bonds shall be expended and the dollar amounts for each project shall be as follows:

to renovate, repair, and/or remodel district-wide, to include, but not be limited to: perform electrical infrastructure/technology improvements and security improvements $400,000.00
