Man Arrested Second Time For Not Registering as Sex Offender

For the second time in less than six months, a Seminole man has been arrested for failure to register as a sex offender.

Bryan Lee Martin, Jr., 26, was arrested on Jan. 14 after Seminole Police discovered that he did not live at the address he had provided when he initially registered as a sex offender. Martin was arrested last August under similar circumstances and on Oct. 9, 2020 he entered a plea of guilty to charges of failure to register.

Martin was required to register as a level one sex offender because, in 2017, he was convicted of assault with intent to commit a felony including sexual assault.

According to an affidavit, Martin walked into the Seminole Police Department on Nov. 16, 2020 and registered his address as 37 Shady Acres, which police say is a compliant address.

Lt. Detective Chris Ayers stated in the affidavit that he had received information that Martin had not lived at Shady Acres for several months.

Ayers made contact with a resident of the listed address, who told him that Martin did not live there, but he had spent the past two nights there. The resident added that her daughter had just taken Martin and his wife to Walmart and would then take them elsewhere, because they were no longer welcome in her home.

According to the affidavit, Ayers located Martin at Walmart and conducted a traffic stop on the vehicle he was riding in. Martin told Ayers that he was compliant and lived at the address he had provided. Martin’s wife disputed that, telling Ayers that they were actually homeless and they “bounced from home to home.”

Ayers said he questioned Martin again, asking him if remembered signing a notice of duty to register, and Martin said he remembered doing that. Ayers then told Martin that if he had read the paperwork, he should know what to do when he found himself unable to live where he had registered.

Martin was placed under arrest on the scene and felony charges were filed against him on Jan. 20 in Seminole County District Court.

According to court records, bond was set at $5,000 and a status conference on the case has been scheduled for Feb. 4.
