Drug Trafficking Charges Filed on Seminole Man
A Seminole man has been charged with one felony count of Trafficking in Illegal Drugs (Methamphetamine), according to documents filed in the District Court of Seminole County.
Felony information states that Joshua Adam McMillan, 38, allegedly possessed methamphetamine, a controlled dangerous substance in Schedule II of the Uniform Controlled Dangerous Substances Act, to-wit: 52 grams.
The probable cause for arrest affidavit filed in this case states that on January 21 at approximately 1:15 a.m. Seminole Police Officer David Young conducted a traffic stop on a vehicle for failing to maintain right on a road of sufficient width.
The affidavit states the distinct odor of marijuana was emitting from the vehicle’s interior, prompting a probable cause search. McMillan, a passenger, stated he did not have a medical marijuana license and had been “smoking” prior to contact with Officer Young.
McMillan was asked to step out of the vehicle and Officer Young performed a pat search. During the pat search Officer Young felt what seemed to be a large bulge in the front of McMillan’s jeans located high and just below the belt that was inconsistent with any male appendage, which Young states in the affidavit he believed to be contraband, based on his training and experience.
Young allegedly located a small black bag with a string attached to the button on McMillan’s pants. He removed the bag and located two clear, plastic baggies containing a crystalline substance, a small bag of a green leafy substance, and a small jewelry bag containing numerous small pills.
The crystalline substance would later have a preliminary weight of 52.5 grams and tested presumptive for methamphetamine, the affidavit states.
Supplemental information filed in this case states on July 31, 2017, McMillan was convicted in the County Court of Cleveland County on one felony count of Endangering Others While Eluding/ Attempting to Police Officer.
On the 1st day ofAugust 2018, McMillan was convicted in the County Court of Oklahoma County on one felony count of Assault &/or Battery With Dangerous Weapon; one felony count of Unauthorized Use of a Vehicle; and one misdemeanor count of Eluding Police Officer, according to the supplemental information.
Bond was set at $150,000, according to an order of commitment filed in this case.
