Burglary Charges Filed After Fishy Alibi Falls Through
The evidence failed to back up the alibi of an alleged burglary suspect claiming he injured himself fishing. Noah Jonathon Brandon Hodges, 35, Holdenville, was instead arrested and charged with Burglary in the Second Degree.
According to a probable cause affidavit, on Thursday, July 15, Wewoka Police Department Captain Joshua Kelly was notified that the Downtown Barber Shop had been broken into. At approximately the same time, EMS had transported a male from the parking lot of a nearby car wash to the Seminole Emergency room with a broken ankle. Kelly was asked to interview the male due to it appearing someone had fallen through the barber shop’s drop ceiling after apparently cutting a hole through the floor of the apartment above the business.
When Captain Kelly arrived at the hospital, he asked Hodges what had happened to his ankle. According to the affidavit, Hodges stated he broke it when he slipped on the rocks while he was fishing near the bridge north of town. He had then crawled and hopped along the main road from the bridge straight to town to get some help.
Kelly called and spoke with Wewoka Assistant Chief of Police Derek Vigil, who informed him he had been sitting at 1st and Mekusukey for a little while prior to the call, and he didn’t see anyone crawling or hopping.
Kelly then informed Hodges it was unfortunate he had broken his foot when he fell through the ceiling and asked how he had cut his foot. Hodges stated he cut it on the rocks he had slipped on when he broke his ankle fishing but refused to remove the band-aid so Kelly could see the wound. Hodges instead became angry and began using profanity, saying he was being harassed. Kelly reminded him he had already been informed of his Miranda rights and had agreed to talk.
When the hospital released Hodges, Kelly asked Hodges for the knife he had noticed in his waistband and informed him he was under arrest, based on the information he had been given from the scene of the crime. Hodges told Kelly he better have some backup because he wasn’t going to jail.
Hodges gave up the knife without incident after Seminole Police officers arrived for assistance. Kelly received the discharge papers from the hospital and Hodges was transported to the Seminole County jail.
During his investigation at the crime scene Kelly found a glove on the roof of the building near where the window appeared to have been broken to gain entry, according to the affidavit. An axe was found on the floor inside the upstairs apartment where a hole had been chopped through the floor. The axe was dusted for fingerprints, but none were found, whether it be from the suspect wearing gloves or wiping the handle clean wasn’t certain. A hammer and a light that could be worn on the head were also recovered.
The affidavit states that a left shoe was found in the area that matched the right shoe Hodges was wearing when he was arrested. The sole of the shoe had two puncture marks consistent with boards found at the scene that had nails sticking up through them. Kelly had previously collected blood droplets found on the floor of the barbershop and had safely submitted them for evidence.
Kelly next reviewed security camera footage from the bank next door during the time of the EMS call. The affidavit states that at approximately 5:47 a.m., according to the time on the camera system, two males come into view. One of the males was hopping and clearly identifiable as Hodges, wearing the same clothes as when he was arrested, according to the affidavit. The other male was heavier-set and wearing a blue hoodie and two different hats, the affidavit states.
Hodges was charged with Burglary in the Second Degree. Bond was set in the amount of $5,000.
