Alleged Larcenist Claimed to be Government Officer
A suspect with an Oklahoma City address faces one felony charge after allegedly claiming to be a government officer tasked with seizing property.
According to the Felony Information filed in this case, Francisco Triana Jr., 36, is charged with one felony count of Grand Larceny, …”by taking and carrying away by fraud or stealth a lawn mower that belonged to (victim), without the consent of (victim), and with the intent to deprive (victim) of the lawn mower permanently.
“This crime is punishable by imprisonment in the State Penitentiary for a term not more than five (5) years, or in the county jail for a term not to exceed one (1) year, by a fine not to exceed $1,000, or both such fine and imprisonment, and restitution. “
The Probable Cause Affidavit filed in the case states that Seminole Sheriff’s Deputy Gary Brooks received a call and responded to a rural address. When he arrived, he made contact with the victim, who stated he had encountered a Hispanic male on his father’s property at the address. The male had a truck and trailer parked on the property and identified himself as a Government Officer and was there to seize all property. The victim dialed 911 and asked for the sheriff to come to the residence.
The victim stated the male had left the property headed north on county road 3580. Deputy Brooks drove north to discover a truck in the roadway that was pulling a trailer with a red Toro Lawn Mower hanging off the back of the trailer. There was a small male standing at the back of the trailer, who was detained and identified as Francisco Triana Jr. who stated he was there to repossess the lawn mower.
Triana was placed under arrest after he could not produce any paperwork to prove he was there to repossess or show any license that he was a repossessor. Deputy Brooks did discover the paperwork he had produced to the victim that was actually a notice of violation from an address in Oklahoma City.
Triana Jr. was transported to the Seminole County Jail where he was booked in.
